These Terms of Service govern your access to msteamer.com, your use of the MSTEAMER store, and any purchase you make from us. MSTEAMER is operated by MSTEAMER, a New Mexico limited liability company. By visiting the site or placing an order, you agree to these Terms of Service and to the policies referenced in them.
1. Eligibility
You must be at least the age of majority in your state of residence and legally able to enter a binding contract. You may not use the site or our products for any unlawful purpose.
2. Store Information and Accounts
You agree to provide accurate, current, and complete billing, shipping, payment, and contact information. You are responsible for activity under your account and for keeping account credentials confidential. We may refuse service, close an account, or cancel an order when reasonably necessary to protect customers, the store, or applicable legal rights.
3. Products and Product Information
We work to describe and display products accurately. Colors, finishes, packaging, and appearance can vary by screen or production batch. Product specifications may be updated when a production configuration changes, provided that the product remains materially consistent with the description shown when you ordered.
Our current MSTEAMER product is a US electrical model intended for the voltage and plug configuration stated on its product label. It is offered for eligible United States delivery addresses only.
4. Electrical Appliance Safety
MSTEAMER is a heated, water-based electrical appliance. Use it only with the voltage stated on the product label. A plug adapter does not convert voltage. Do not overfill the tank, immerse the unit, leave it unattended while connected, point steam toward people or animals, or touch hot surfaces. Allow the unit to cool before storage. Follow the included instructions and the care label of every garment.
5. Orders
Submitting an order is an offer to purchase. An order confirmation acknowledges receipt but does not guarantee acceptance. We may accept, reject, limit, or cancel an order because of inventory, payment authorization, suspected fraud, pricing errors, shipping restrictions, or product availability. If we cancel a paid order, we will refund the amount charged.
6. Prices and Payment
Prices are displayed in US dollars unless the checkout states otherwise. Applicable taxes, shipping charges, discounts, and other charges are disclosed before you submit the order. Prices and promotions can change without notice, but changes do not affect an order already accepted.
You authorize the selected payment provider to charge the total shown at checkout. Payment processing services may be subject to additional terms from the payment provider.
7. Shipping and Delivery
Available delivery methods, charges, tracking, and delays are governed by our Shipping Policy. Delivery dates are estimates unless we expressly state that a date is guaranteed.
8. Returns, Cancellations, and Refunds
Returns, cancellations, damaged items, and refunds are governed by our Return and Refund Policy. Any rights provided by applicable law remain available to you.
9. Promotions and Gifts
Promotions may have separate conditions and may be modified or ended as permitted by law. Unless stated otherwise, promotions cannot be combined. A free gift supplied with a purchase must be returned with the qualifying order if the entire order is returned, unless we tell you otherwise.
10. Intellectual Property
The MSTEAMER name, site design, original copy, graphics, photographs, videos, and other brand assets are owned by MSTEAMER or used with permission. You may not reproduce, distribute, sell, publish, or commercially exploit them without prior written permission, except as permitted by law.
11. Reviews and Other Submissions
If you submit a review, photo, video, suggestion, or other content, you confirm that you have the right to submit it and that it is accurate, lawful, and does not violate another person's rights. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and adapt that content for operating and promoting MSTEAMER. We may remove content that violates these terms or applicable law.
12. Prohibited Conduct
You may not use the site for fraudulent, abusive, infringing, deceptive, or harmful activity. You may not interfere with site security, introduce malicious code, scrape protected customer or account data, attempt unauthorized access, impersonate another person, or use automated systems in a way that disrupts the Services.
13. Third-Party Services
The store uses third-party services, including Shopify, payment processors, carriers, analytics providers, and advertising platforms. Third-party services and links may be governed by separate terms and privacy practices. We are not responsible for a third-party website that we do not control.
14. Disclaimer of Warranties
To the maximum extent permitted by law, the site and products are provided subject only to warranties expressly stated in writing and rights that cannot legally be excluded. We do not promise that the site will always be uninterrupted, error-free, or free of harmful components.
15. Limitation of Liability
To the maximum extent permitted by law, MSTEAMER and its officers, members, employees, contractors, and service providers are not liable for indirect, incidental, special, punitive, or consequential damages arising from use of the site or products. Any liability that cannot be excluded is limited only to the extent permitted by applicable law. Nothing in these terms limits liability that cannot legally be limited.
16. Indemnification
To the extent permitted by law, you agree to indemnify MSTEAMER against third-party claims, losses, and reasonable costs arising from your unlawful use of the site, your violation of these terms, or your violation of another person's rights.
17. Severability and No Waiver
If any provision is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
18. Governing Law
These terms are governed by the laws of the State of New Mexico and applicable federal law, without regard to conflict-of-law principles. This section does not remove any consumer protection rights that apply to you under mandatory law.
19. Changes to These Terms
We may update these terms by posting a revised version and changing the date above. Changes apply from their effective date and do not reduce rights already attached to a completed purchase.
